Terms of Sale — The Bitcoin Credit Stack
THE BITCOIN CREDIT STACK — TERMS OF SALE
Version: 0.2 · Effective date: 21 October 2026
These terms of sale (the "Terms of Sale") are offered by ALETHEIA ANALYTICS, a French société par actions simplifiée à associé unique with share capital of EUR 1,000, registered with the Paris Trade and Companies Register under number 107 152 662 R.C.S. Paris, with its registered office at 173 rue de Courcelles, 75017 Paris, France (the "Publisher"). The EU VAT number will be added once it has been issued. Contact: contact@aletheia-analytics.io.
1. Purpose and scope
1.1. These Terms of Sale govern the Publisher's sale of paid answers from The Bitcoin Credit Stack (the "Stack"): the REST API published at api.bitcoincreditstack.com and the MCP server published at mcp.bitcoincreditstack.com/mcp, and, when they are offered, the credits and the plan described in Article 10.
1.2. Use of the Stack (the site www.bitcoincreditstack.com, the API and the MCP server), free or paid, is governed by the Stack's Terms of Use (the "Terms of Use"). Rights in the data received are governed by the Stack's Data Licence (the "Licence"). Personal data processed in connection with a payment is described in the Stack's Privacy Policy. These documents are published at www.bitcoincreditstack.com/legal.
1.3. In case of conflict, these Terms of Sale prevail on price, payment, formation and performance of the sale; the Terms of Use prevail on use; the Licence prevails on rights in the data.
1.4. These Terms of Sale do not govern the thegavel.io interface, the Gavel protocol or the mcp.thegavel.io MCP server, which have their own documents. An offer on quotation (volume, redistribution) is made under a separate contract.
2. Definitions
2.1. "Call": a request sent to the Stack's API or MCP server, and the answer made to it.
2.2. "Cost class": the price category of a Call, set by the Price List: catalogue, reading, snapshot or history.
2.3. "Priced Call": a Call of the snapshot or history class.
2.4. "Price List": the single file in which the Publisher writes its prices (pricing/price-list.json), identified by a version number.
2.5. "Free Allowance": the number of Priced Calls an anonymous caller may make free of charge per UTC day (Article 6).
2.6. "Payer": the person, or the software agent acting for that person, who pays for a Call or buys credits or a plan. Where a software agent pays, the person on whose behalf it acts is the Payer.
2.7. "Rail": a means of payment accepted by the Publisher (x402, Lightning, card through Stripe).
2.8. "Answer": the content the Stack returns for a Call, including its values, its absences with their reasons, its source blocks (providers, attribution) and its metadata.
3. Who these Terms of Sale are for
3.1. The Stack is a data service for professionals: analysts, businesses, developers and the software agents they deploy. These Terms of Sale are addressed to Payers acting for professional purposes. By paying for a Call, credits or a plan, the Payer declares that it acts for purposes within its trade, business, craft or profession.
3.2. The Publisher cannot verify this declaration for a payment made by a software agent without an account. Where the Payer is nevertheless a consumer, the mandatory provisions that protect consumers apply, in particular Article 14 (withdrawal) and Article 18 (mediation).
4. What is sold
4.1. Answers, by cost class. The Publisher sells the Stack's Answers per Call, at the price of their cost class in the Price List. Catalogue and reading Calls are free. Priced Calls are free within the Free Allowance, then paid.
4.2. Later, credits and a plan. The Publisher may offer prepaid credits and a plan, payable by card (Article 10). At the date of these Terms of Sale, neither credits nor a plan are offered.
4.3. A paid answer is the free answer. The content of a paid Answer is exactly that of the free Answer to the same Call: the same values, the same words, the same absences with their reasons, the same sources. Payment buys no additional data, no priority, no particular freshness and no exclusivity.
4.4. An absence is an answer. Where a value cannot be established, the Answer says so with its reason, instead of a zero. An Answer that contains absences with their reasons is a delivered Answer.
4.5. Information only. What is sold is information. Through the sale the Publisher provides no advice, recommendation, mandate, execution, custody or regulated service; the Stack prepares, signs and broadcasts no transaction. Nothing in the Stack assesses a person. The Publisher has a commercial interest in the Gavel protocol, where it holds positions on its own account; this is stated on Gavel's row in every answer. These points are set out in the Terms of Use.
4.6. No service level. The sale carries no commitment on availability, response time or coverage beyond what the Terms of Use describe.
4.7. Rights in the data. The rights granted in a paid Answer are those of the Licence, which works by provider: only the Publisher's own values and attributed values are licensed for paid use; values under restrictive or unknown third-party terms are supplied attributed, without a licence from the Publisher.
5. Prices and the Price List
5.1. One list. Prices are those of the Price List in force. At the date of these Terms of Sale (version 2026-10-19.3) they are, in US dollars and including all taxes (Article 11):
| Cost class | Price | Unit |
|---|---|---|
| Catalogue | free | — |
| Reading | free | — |
| Snapshot | USD 0.01 | per Call |
| History | USD 0.02 | per Call; on the series routes (/v1/series/values, /v1/onchain/series/:id), per distinct series asked for |
"As known on" (as_known_on, a past date) |
twice the class price | — |
5.2. How the price is shown. The price of a Priced Call past the Free Allowance is shown in machine-readable form in the HTTP 402 answer to that Call (the PAYMENT-REQUIRED header), before any payment. The price applicable to a Call is the one carried by the 402 answer to that Call. The Price List is also published at www.bitcoincreditstack.com/legal/pricing.
5.3. Price per series. On the series routes, the price is computed on the number of distinct series asked for in the Call, whether each series is served by a value or by an absence with its reason.
5.4. Price changes. The Publisher may change the Price List. A new version applies to Calls made after its publication; it does not change the price of a Call already paid. For the plan, a price change would apply from the next period, after the subscriber has been informed.
6. The Free Allowance
6.1. Each anonymous caller has 100 free Priced Calls per UTC day. The anonymous caller is recognised by a daily pseudonym, computed from its network address (the /64 for IPv6, the address for IPv4) and renewed each day; it is described in the Privacy Policy.
6.2. A Priced Call is taken from the Allowance when it arrives; if it fails (a 4xx or 5xx error answer), it is credited back.
6.3. The Allowance is a courtesy granted by the Publisher, not an acquired right. It is counted in memory: a restart of the service may reset it for the day. It may be unavailable to a new caller when the number of distinct callers in the day reaches the service's technical limit, or when many callers share one IPv6 network block (/48). The Publisher may change its amount or withdraw it; the change is published in the Price List and at www.bitcoincreditstack.com/legal/pricing at least seven days before it applies.
7. Calls never charged
Never charged, and never refused for lack of payment:
- catalogue and reading Calls, and any route the Price List does not price;
- the Stack's own site pages, and its servers;
- Calls the Stack's MCP server makes to the API on the same machine; accordingly, at the date of these Terms of Sale, Calls made to the MCP server are not charged (they are counted);
- Calls carrying an API key (the credits regime, Article 10);
- the chart served by the Stack (
/v1/series/chart.svg, reading class).
8. Payment by x402 (USDC on Base)
8.1. Status. Payment by x402 is not yet open to the public. It opens after publication of these Terms of Sale, the Terms of Use, the Licence and the Privacy Policy and the Publisher's own check. Until it opens, no Call is charged or refused for lack of payment.
8.2. How it works. Past the Free Allowance, a Priced Call to the API receives an HTTP 402 answer carrying, in the PAYMENT-REQUIRED header, the price, the asset (USDC), the network (Base, eip155:8453), the payment scheme (exact) and the Publisher's receiving address. A Payer who wants the Answer repeats the Call with a payment authorisation signed by its own wallet. The payment is settled through Coinbase's facilitator (CDP) directly to the Publisher's receiving address; no wallet of the Publisher signs anything.
8.3. Formation and completion of the sale. The sale is formed when the payment authorisation is sent at the price carried by the 402 answer. It is complete when the facilitator reports settlement and the Answer is delivered, with the PAYMENT-RESPONSE header.
8.4. Failures. If the facilitator is unavailable or fails, before the Answer or at settlement, the Call receives a 503 answer (payment_unavailable) and the Answer is not delivered. If the facilitator refuses the payment, the Call receives a new 402 answer. A Call whose Answer is an error (4xx or 5xx) is not charged.
8.5. Screening by the facilitator. The facilitator may refuse a payment, including under the sanctions screening it applies to payers. The Publisher need not give reasons for such a refusal and does not pass on the facilitator's text.
8.6. Third-party costs. Any network, wallet or provider costs the Payer bears with third parties remain the Payer's; they are not received or controlled by the Publisher.
9. Payment in bitcoin over Lightning (may be offered)
9.1. The Publisher may offer payment for Priced Calls in bitcoin over the Lightning network (L402), after x402 has opened. At the date of these Terms of Sale, this Rail is not offered.
9.2. If offered: payment will be received by a Lightning node of the Publisher that only receives. The node forwards no one else's payments: its channels are private and it routes nothing. The price will be the Price List's, converted into satoshis at the day's rate, with the source of the rate named. The sale will be complete when the Lightning invoice is settled and the Answer delivered.
9.3. Until counsel has answered on sanctions screening, this Rail will open only after x402, whose facilitator screens payers, or through a Lightning provider that screens payers.
10. Credits and a plan by card (Stripe) — not offered
10.1. Status. At the date of these Terms of Sale, no prepaid credits and no plan are offered. If the Publisher offers credits or a plan payable by card through Stripe, their terms (amounts, validity, allowance, renewal, cancellation and payment) will be set out in a new version of these Terms of Sale, published before they open.
11. VAT
11.1. Unidentified payers (x402, and Lightning if offered). A Payer who pays without an account is not identified: the Publisher knows neither its country nor its status. Price List prices on these Rails include all taxes, including French VAT at 20%. Thus a snapshot Call at USD 0.01 includes USD 0.00167 of VAT on USD 0.00833 excluding tax.
11.2. Credits and plan (Stripe). Prices of credits and of the plan exclude VAT. VAT is computed by Stripe Tax according to the customer's country. A business customer established in another EU Member State that gives a valid EU VAT number is invoiced without VAT, the tax being self-assessed by it (reverse charge); the invoice carries the words "Autoliquidation". This regime will open only once the Publisher's VAT number is issued and Stripe Tax is configured.
12. Receipts and invoices
12.1. x402. The receipt for an x402 payment is the settlement recorded on the Base blockchain (public and permanent, identified by its transaction hash) together with the PAYMENT-RESPONSE header attached to the Answer, which names the network, the transaction and the payer's address. The Payer should keep them.
12.2. Invoice on request. An invoice is issued on request sent to contact@aletheia-analytics.io, giving: the transaction hash or hashes, the paying wallet's address, and the name, address and, where applicable, VAT number of the person to be invoiced. The invoice is drawn up in euros, at the conversion rate the Publisher uses for the date the payment was received, and shows the VAT included in the price (Article 11.1). Several Calls paid from one wallet may be grouped on one invoice.
12.3. Stripe. For credits and the plan, Stripe issues the invoice, with the applicable VAT.
12.4. The Publisher keeps its accounting records, including the paying address and the transaction hash, for ten years (Article L123-22 of the French Commercial Code), as described in the Privacy Policy.
13. Delivery, refunds, failed calls
13.1. The Answer is delivered at once, in the HTTP (or MCP) response to the Call. There is no other delivery.
13.2. A delivered Answer is not refunded, including where it contains absences with their reasons. An x402 payment settled on the blockchain cannot be reversed, and the Stack has no refund mechanism.
13.3. A Call that fails (a 4xx or 5xx answer) is not charged and does not use the Free Allowance. Where settlement fails, the Answer is not delivered and nothing is owed (Article 8.4).
13.4. A Payer who believes it was charged without receiving the Answer sends a complaint to contact@aletheia-analytics.io with the transaction hash (Article 18).
14. Right of withdrawal
14.1. These Terms of Sale are addressed to professionals, who have no right of withdrawal.
14.2. Where the Payer is a consumer, the Answer is digital content supplied without a tangible medium, whose performance begins at once. By asking for a paid Answer past the Free Allowance and paying for it, the Payer expressly asks for its immediate supply and acknowledges that it thereby loses its right of withdrawal once it is supplied (Article L221-28, 13° of the French Consumer Code). This request and acknowledgement are repeated in the 402 answer that precedes any payment (Annex A).
14.3. For credits and the plan, if they are offered to consumers, the purchase flow will collect express consent and the acknowledgement of loss of the right of withdrawal before performance begins; failing that, the fourteen-day right of withdrawal will apply on the statutory terms.
15. The Publisher receives payments for its own data
15.1. The Publisher receives payments in return for its own data. It holds no asset for the Payer, transfers no asset for a third party and executes no order: the Payer pays from its own wallet, and the payment is received at the Publisher's address, which is a receiving address only.
15.2. Payments received in USDC or bitcoin remain the Publisher's assets; holding or converting them is the Publisher's own management and does not affect the Payer.
16. Liability
16.1. The Publisher's liability for Answers is governed by the Terms of Use. Under these Terms of Sale, the Publisher is liable only for direct and foreseeable loss resulting from a proven breach of an obligation they impose on it; it is not liable for indirect loss or for loss of profit, revenue, opportunity or data.
16.2. For a professional Payer, and except where the law prohibits such a limitation, the Publisher's aggregate liability under these Terms of Sale is capped at the sums paid by that Payer in the twelve months before the event giving rise to it.
16.3. These limitations do not apply in case of fraud, wilful misconduct or gross negligence where it cannot lawfully be limited, or to any liability that cannot be limited under applicable law. A consumer Payer keeps all mandatory statutory rights.
17. Changes to these Terms of Sale, and evidence
17.1. The Publisher may change these Terms of Sale. Each version carries a number and a date and is published at www.bitcoincreditstack.com/legal/terms-of-sale. The version applicable to a Call is the one in force when it is paid. A plan subscriber is informed of a change that concerns it before the period to which it applies.
17.2. Electronic records, public blockchain data and payment headers may serve as evidence under applicable law.
18. Complaints and consumer mediation
18.1. Questions or complaints about a sale should first be sent to contact@aletheia-analytics.io or by post to ALETHEIA ANALYTICS, 173 rue de Courcelles, 75017 Paris, France.
18.2. Where the Payer is a consumer and mandatory consumer mediation rules apply, the Payer may refer an unresolved dispute to the competent consumer mediator after first sending a written complaint to the Publisher. At the date of these Terms of Sale, the Publisher has not yet adhered to a consumer mediation scheme. The name and contact details of the competent mediator will be published in these Terms of Sale once adhesion is effective.
18.3. The availability of consumer mediation does not deprive the Payer of the right to bring proceedings before a competent court.
19. Governing law and jurisdiction
19.1. These Terms of Sale are governed by French law.
19.2. Where the Payer is a consumer, the choice of French law does not deprive it of the mandatory protections of the law of its habitual residence where they apply; consumer disputes go to the courts designated by the applicable mandatory rules.
19.3. Where the Payer acts for professional purposes, any dispute concerning these Terms of Sale falls within the exclusive jurisdiction of the competent courts of Paris, France, subject to any contrary mandatory rule.
20. Language
These Terms of Sale are written in French, which is the authoritative version. An English translation is published; in case of divergence, the French version prevails.
