Publishing this as a "BTC borrow rate" without that sentence would imply a product that does not exist.

The collateral is etp_share, which is economically bitcoin and legally a security; a holder can never redeem shares for coins, so this is a claim on a trust rather than on the coins (section 6.1, D31).
